S2S Express Terms and Conditions
Welcome to the Terms and Conditions ("Terms") for Site to Store Express ("S2S Express"). These Terms are between you and Wal-Mart.com USA, LLC and/or its affiliates ("Walmart.com"), and govern our respective rights and obligations. These Terms constitute the entire agreement between you and Walmart.com related to the S2S Express service. Please note that your use of the Walmart.com site and S2S Express service are also governed by the Walmart.com Privacy Policy. and the Walmart.com Site Terms and Conditions, all of which (as changed over time) are incorporated into these Terms. If you sign up for the service, you accept these terms, conditions, limitations and requirements. Please read these Terms carefully.

Program Benefits
S2S Express customers will receive expedited Site to Store delivery of S2S Express eligible products at no additional cost. We estimate that S2S Express customers will generally be able to pick up S2S Express eligible products from the store within three to five business days (plus processing time) from the date the order is placed. Walmart.com does not guarantee delivery of S2S Express products within the estimated time or by an estimated delivery date. Walmart.com also does not guarantee that use of S2S Express will in all circumstances provide faster shipping for all customers and products than use of Site-to-Store. While the majority of the products shipped through S2S Express utilize delivery methods likely to increase shipping speeds over those realized through regular Site-to-Store, certain products may be shipped using similar or the same methods and processing times can vary.

Walmart.com Account Required
To sign up for the S2S Express service you must have a Walmart.com account. Existing Walmart.com account holders may use their existing account to sign up for the S2S Express service. New users must create a Walmart.com account at the time of sign up for the S2S Express service. To create a new account, you must provide a first and last name, valid email address, year of birth (to ensure privacy and security of children) and password. We use this information to protect your account from unauthorized access and to notify you of the status of any purchases you make. We may ask you to confirm your personal information when you contact our Customer Service department. This will allow us to protect your confidentiality by verifying your identity.
A Walmart.com account provides access to all Walmart.com services. You will have the ability to view service features, check expiration, renew and cancel the S2S Express service, update contact information and manage other aspects of your account through "My Account".

S2S Express Eligible Products
The S2S Express service is limited to certain products sold by Walmart.com, but will generally include the same items that are eligible for Walmart.com's Site to Store service. Products are eligible for S2S Express only if designated as such on the Walmart.com site. Walmart.com may exclude any product in its discretion, including, for example, perishable items, products that contain hazardous materials and oversized items.

Conditions and Restrictions for S2S Express Service
Each S2S Express service account is valid for one unique Walmart.com account. S2S Express service accounts are not transferable or assignable. Walmart.com reserves the right to accept, refuse or terminate an account or the S2S Express service in its discretion.
S2S Express is not available in Alaska, Hawaii or outside the continental United States. S2S Express service can only be used for personal, non-commercial use, and is not available for customers who purchase Walmart.com items for the purpose of resale. Walmart.com reserves the right to terminate a S2S Express service account if it suspects a Walmart.com account holder is using its S2S Express service account for commercial purposes.
If only some of the items in your order are S2S Express eligible products, the S2S Express eligible products may be shipped separately to the store.

Fees and Renewal
The annual service fee, and any applicable taxes, are non-refundable except as expressly set forth in "Cancellation/Termination of Membership" below. Your S2S Express service account will expire on the anniversary of the date the service is purchased. UNLESS YOU NOTIFY WALMART.COM THAT YOU WANT TO CANCEL YOUR S2S EXPRESS ACCOUNT BEFORE THE ANNIVERSARY OF THE DATE YOU PURCHASED YOUR ACCOUNT, YOU UNDERSTAND YOUR ACCOUNT WILL AUTOMATICALLY RENEW AND YOU AUTHORIZE US (WITHOUT NOTICE TO YOU) TO COLLECT THE THEN-APPLICABLE SERVICE FEE AND ANY TAXES, USING THE PAYMENT METHOD THAT WAS PREVIOUSLY USED TO PURCHASE OR RENEW YOUR S2S EXPRESS ACCOUNT.

Cancellation/Termination of Account
You may cancel your S2S Express service account at any time, provided that you will receive a refund only if you have not yet purchased an S2S Express eligible product since purchasing or renewing your S2S Express service account. You must contact Walmart.com customer service via email to request cancellation of your S2S Express service account and to receive a refund of the service fee.
Walmart.com reserves the right to terminate any S2S Express service accounts at its discretion without notice. Walmart.com's failure to insist upon or enforce your strict compliance with these Terms and Conditions will not constitute a waiver of any of its rights.

Modification
Walmart.com reserves the right to update or modify these Terms and Conditions at any time without notice to you. Notwithstanding the foregoing, any change in the service fee will not apply until your service is renewed.

Limitation of Liability
Walmart.com, and its parent, subsidiaries, affiliates, suppliers, partners, directors, officers, consultants and employees will not be liable to you for any direct, indirect, special, incidental, consequential, or punitive damages, or any other damages of any kind, arising out of or related to your S2S Express service account, including, without limitation, damages resulting from the outage or disruption of service or the failure to meet estimated delivery times. The total liability of Walmart.com, whether in contract, warranty, tort (including negligence) or otherwise, will not exceed the last annual S2S Express service account fee you paid. These exclusions and limitations of liability will apply to the fullest extent permitted by law and will survive cancellation or termination of your account. Certain state laws do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above exclusions or limitations may not apply to you, and you may have additional rights.

Indemnity
By using the S2S Express service, you agree to indemnify Walmart.com and its parent, subsidiaries, affiliates, suppliers, partners, directors, officers, consultants and employees and hold them harmless from any and all claims and expenses, including attorney's fees, arising from your use of this service, including any violation of these Terms and Conditions.
